General Terms and Conditions (GTC)

SOS-ID GmbH · February 2026 · Version 1.6-oT

§ 1 Scope & Formation of Contract

The business relationship between SOS-ID GmbH and the customer is governed exclusively by the following General Terms and Conditions. We will only accept deviating or supplementary conditions of the customer if we have expressly agreed to their validity in writing.

For customers who have purchased our SOS-ID chips from third parties, these GTC apply with the exception of provisions relating to our delivery obligations and remuneration.

The presentation of our products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the "Order with obligation to pay" button, you place a binding order. Confirmation of receipt of your order is sent together with acceptance via automated e-mail. The purchase contract is concluded upon receipt of this e-mail.

  • Contracting party: SOS-ID GmbH, Cassellastraße 30–32, 60386 Frankfurt am Main
  • E-mail: info@id-no.com
  • Platform: www.id-no.com

§ 2 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you (who is not the carrier) took possession of the goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. letter, fax, e-mail) of your decision to withdraw from this contract. You may use the enclosed model withdrawal form, though it is not mandatory. It is sufficient to send the notification before the withdrawal period expires.

  • Withdrawal to: SOS-ID GmbH, Cassellastraße 30–32, 60386 Frankfurt am Main
  • E-mail: info@id-no.com
  • Deadline: 14 days from receipt of goods

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the day on which we received notification of your withdrawal. Reimbursement uses the same means of payment as the initial transaction, unless expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods. You must return the goods without undue delay and in any event no later than 14 days from the day of notification of withdrawal. The customer bears the direct cost of returning the goods.

§ 3 Service Description

SOS-ID provides a digital platform for recording, managing and making available personal emergency and health data. Data is retrievable via a SOS-ID QR code or an individual ID number.

User Account and Profiles

Upon initial registration, a personal user account is created. Multiple personal profiles can be created and managed (e.g. for family members).

  • Set profiles to active or inactive (visible / not visible)
  • Specify which information is displayed in an emergency
  • Assign specific SOS-ID products to individual profiles

Each SOS-ID product can be assigned to one profile at a time. The assignment can be changed by the user at any time.

  • Free usage period: 12 months
  • Extension: only with express consent (in writing or electronically)
  • Advance notice: at least 4 weeks before expiry

Storable Data

  • Personal contact details
  • Medical emergency information (e.g. blood type, allergies, medications, conditions)
  • Supplementary patient details (e.g. surgical history, preventive care notes, advance directives)
  • Health insurance information

Only information released by the user is displayed in an emergency.

Processing of emergency and health data is based on Art. 9 para. 2 lit. a GDPR (explicit consent). Details: Privacy Policy Section 7.

Responsibility for Content

The entry, accuracy and currency of stored data is the sole responsibility of the user. SOS-ID GmbH provides only the technical infrastructure. No medical advice, review or assessment of content is provided.

Access and Data Security

Employees of SOS-ID GmbH have no regular access to protected emergency data. Only information publicly released by the user is visible. Access to non-public data is permitted only in justified exceptional cases and exclusively by authorised IT specialists.

Details on technical security measures and encryption: Privacy Policy Section 7.4.

Emergency Use and Service Limitations

SOS-ID does not replace medical care or emergency treatment. Access to stored data requires a third party to use the QR code or ID number, and the platform must be technically accessible at the time of retrieval. SOS-ID GmbH does not guarantee that stored data will actually be accessed in an emergency.

Transferability of the Chip

SOS-ID products can be assigned by the user to another person. Before passing on the product, it must be removed from the existing profile and assigned to a new profile, or the assignment must be removed entirely. SOS-ID GmbH assumes no liability for damages arising from incorrect or omitted reassignment.

Loss or Theft of the Chip

In the event of loss or theft, the user must immediately deactivate the affected ID number or remove the profile assignment. Deactivation or modification can be performed at any time via the user account. SOS-ID GmbH assumes no liability for damages arising from delayed or omitted action.

§ 4 Prices and Payment

Prices shown in the shop on the day of the order are in euros, including statutory VAT, plus shipping costs.

  • Payment methods: Direct debit, Credit card, PayPal, Advance payment
  • Payment due: within 5 days of receipt of invoice
  • Payment processing: Stripe Technology Company Limited, Dublin, Ireland
  • Non-EU deliveries: Net (excluding German VAT); any customs duties, taxes and import charges are borne by the buyer.
Details on data processing by Stripe: Privacy Policy Section 8.

§ 5 Retention of Title

The goods remain the property of SOS-ID GmbH until full payment has been received.

§ 6 Term, Extension, Basic Mode and Termination

The usage agreement is concluded for an indefinite period. The digital emergency data service is available free of charge for 12 months from registration.

The user will be notified at least 4 weeks before expiry of the free period and of the option to extend. Extension only with express consent. This is explicitly not a subscription and there is no automatic renewal.

  • Free period: 12 months
  • Advance notice: at least 4 weeks before expiry
  • Extension: express consent only
  • Membership: refers to the service, not to individual products
  • Multiple products can use the same service

If the service is not extended, the account is automatically switched to a limited, free Basic Mode. The account remains active but with reduced functionality.

Basic Mode

  • Available: Personal information + 2 emergency contacts (retrievable in emergency)
  • Not displayed: Medical conditions, medications, allergies, other health data
  • Data storage: Health data remains stored until reactivation or account deletion
  • Editing: Changes to health data not possible or only limited
  • Reactivation: Full functionality available at any time via paid extension

Termination

  • By user: at any time, without giving reasons – via account deletion or e-mail to info@id-no.com
  • By SOS-ID: SOS-ID waives its right of ordinary termination. The mutual statutory right to extraordinary termination for good cause (e.g. serious misuse, hacking attacks, upload of illegal content) remains unaffected.
  • Effect: Access ends, data deleted (subject to statutory retention obligations). No return of SOS-ID products required.
Information on data deletion and retention periods can be found in the Privacy Policy.

§ 7 Death of a User

The contract passes to the heirs in accordance with statutory provisions. We support bereaved relatives in a swift and straightforward process.

Account deletion or full deactivation can be requested informally by e-mail to info@id-no.com. Proof (e.g. death certificate) may be requested if there is reasonable doubt as to the legitimacy of the requesting person.

Transfer of the existing account to another person or modification of the data is excluded. The account is deleted promptly and irrevocably upon request by the bereaved.

§ 8 Obligations of the Customer

The customer must provide truthful information upon registration and keep data up to date – in particular contact details and, where stored, medical emergency information.

Privacy Policy Section 3.1 and Section 10.

§ 9 Warranty

Statutory warranty rights apply. No additional guarantees are provided beyond these statutory rights.

§ 10 Liability

We are subject to unlimited liability for intent and gross negligence, as well as for injury to life, body or health.

In the event of slightly negligent breach of material contractual obligations (cardinal obligations, the fulfilment of which is essential to the proper execution of the contract and on which the customer regularly relies), liability is limited to the foreseeable damage typical for the type of contract. Any further liability for slight negligence is excluded.

Subject to the foregoing, we do not guarantee the continuous and uninterrupted availability of id-no.com in an emergency.

§ 11 Data Protection

Personal data is processed exclusively for the performance of the contract and in accordance with statutory requirements. Medical data is processed only with the express consent of the user.

Full information on data processing, your rights and retention periods can be found in our Privacy Policy at www.id-no.com/datenschutz.

§ 12 Right to Amend

SOS-ID GmbH reserves the right to amend these GTC and the scope of services on objective grounds (e.g. legislative changes, technical developments, changed market conditions).

Registered users will be informed of material changes at least 4 weeks before they take effect. If the user does not object within 4 weeks, the changes are deemed accepted. The right to object is expressly stated in the notification.

In the event of an objection, SOS-ID GmbH is entitled to terminate the contract by ordinary notice at the time the changes take effect.

§ 13 Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr

SOS-ID GmbH is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Choice of Law

German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence.

§ 15 Storage of Contract Text

We do not store the contract text permanently. You can print your order data immediately after submitting your order. You will also receive an order confirmation with all contract details by e-mail.
